The firm protects clients’ privacy and the security of their non-public personal information (“NPI”) in accordance with all laws, regulations, and the codes of professional responsibility of the jurisdictions in which its attorneys are licensed to practice law (Rhode Island and Massachusetts). Personal data will be collected only for the purposes specified. The data must be relevant but not excessive for those purposes. It will be protected so as to minimize the risk of unauthorized or unlawful disclosure, as well as against its accidental loss, damage, or destruction. It will not be removed from our offices, except in the custody of an attorney or authorized staff personnel. It will also not be kept for longer than necessary.
The guiding principal of this policy is best reflected by the following official comment to the Rhode Island Supreme Court Rules of Professional Conduct [Rule 1.6]: “The … ethical obligation … [is] to hold inviolate confidential information of the client…The common law recognizes that the client’s confidences must be protected from disclosure.”
It is the position of the firm that, in its determination of the “reasonableness” of this Policy, it has developed a policy that is appropriate to, and consistent with, both the firm’s size and complexity, the nature and scope of its business, and the sensitivity of the client information that it handles on a daily basis.
